El inminente tratamiento en senadores del proyecto de ley de declaración de esencialidad de la educación con media sanción en diputados acelera la necesidad de profundizar el debate sobre sus implicancias. ¿Qué relación existe entre este proyecto y las declaraciones de Milei de que vino a «dinamitar» el estado por dentro?
Importantes contribuciones al debate se han hecho desde los sectores opuestos al proyecto señalando su hipocresía ya que bajo el enunciado de esencialidad se esconde una política contraria por parte de un gobierno que ha desfinanciado la educación en todos sus niveles y modalidades. Desde el inicio de su gestión, el gobierno de la Libertad Avanza (LLA) seguido por los provinciales, radicales, del PRO y peronistas, han desatado un brutal ajuste contra el salario docente, los insumos escolares, la infraestructura escolar, los comedores, las becas estudiantiles y hasta la capacitación docente. Basta ilustrar con el dato de que el gobierno nacional cerró la paritaria fijando el salario de un maestro en $420.000 para julio, cuando el INDEC señalaba que la canasta de pobreza era de $929.845, fecha en que los docentes universitarios acusaban 55% de pérdida de salario.
Se ha denunciado con absoluta corrección que el proyecto atenta contra el derecho de huelga como parte de un plan de reforma laboral contra un sector de trabajadores que a la fecha ha logrado conservar derechos que otros perdieron desde la ofensiva neoliberal de los 90 durante el gobierno de Menem y sus sucesores tales como: estabilidad laboral, vacaciones, jubilación, licencias, concursos públicos.
Se han difundido, incluso, argumentos legales que señalan la inconstitucionalidad del proyecto, así como la violación de los convenios internacionales de la OIT que nuestro país suscribe.
Finalmente se ha denunciado la inviabilidad de su ejecución ya que es irresponsable suponer que un establecimiento educativo puede funcionar con un tercio de su personal o incluso la mitad, a riesgo de poner en peligro la seguridad de la niñez o adolescencia a cargo, así como que sería impracticable realizar actos pedagógicos en ese marco. La única función efectiva, en caso de aprobarse, sería brindar guarda a las hijas e hijos de las familias trabajadoras para que los empresarios no tengan ausentismo laboral.
En este trabajo queremos aportar al debate otro ángulo de la crítica, enmarcada en la política global del gobierno de la LLA. Cuando Milei dice, con absoluto impudor, que viene a “dinamitar” el estado por dentro, no miente. Aunque habría que precisar que lo que quiere destruir es todo aquello que responda a algún derecho social en el actual estado, y en cambio mantener su función represiva y de control: SIDE, ejército, gendarmería, policía. En lo que a educación se refiere, su intención es destruir el sistema educativo público estatal tal como lo conocemos. Y para implementar esta destrucción, necesita derrotar la capacidad de resistencia del gremio docente mediante herramientas como el proyecto de esencialidad de la educación que estamos analizando.
A la fecha, no se ha tomado suficiente nota de las implicancias que tiene la reciente decisión de poner bajo la órbita de Federico Sturzenegger, flamante ministro de Desregulación y Transformación del estado, a la degradada Secretaría de educación de la nación bajo la administración de Carlos Torrendell. El sistema educativo estatal es una preciada “joya de la abuela” que desde hace algunas décadas está bajo la mira de intereses de empresas privadas y lobbies de educación, algo que también ocurre a nivel mundial. El estado argentino, con variaciones, destina poco más del 5% de su PBI como gasto consolidado nacional para educación (sumados los presupuestos provinciales alrededor del 4% y la nación,1,2%). En el mundo esta cifra ascendía a 4,4% del PBI en 2022[i]. Frente a la crisis del capitalismo mundial, una de las recetas de los organismos internacionales es promover las alianzas público-privadas (APP). Los empresarios buscan asociarse al estado para influir en las decisiones gubernamentales de inversión, usufructuar de los fondos presupuestarios que se logran con los impuestos a las grandes masas de trabajadores y desarrollar empresas mixtas donde se benefician de exenciones impositivas. El estado pone fondos, la expertise de sus técnicos e investigadores y corre con los mayores riesgos en caso de emprendimiento fallido.
En educación este diseño de APP estaría en la mira de la reforma del estado para educación de la mano de la dupla Sturzenegger-Torrendell. Sturzenegger es el artífice del DNU y de la Ley bases de destrucción del estado y entrega de las empresas públicas y de los recursos naturales a la rapiña de los capitales privados. Estos proyectos fueron trabajados con su equipo durante años y hoy cuenta con la plataforma que le brinda Milei para aplicarla. La educación entra en este plan en un doble sentido: como negocio y como parte de la batalla cultural de la derecha contra la izquierda que Milei promociona.
En educación, lo privado viene de la mano de empresarios nacionales, multinacionales con filiales en el país, ONGs e iglesias. Las APP refuerzan la idea preexistente en los sectores dominantes de que la educación es un servicio, no un derecho social. La narrativa de quienes defienden estas alianzas es que la escuela debe ser administrada como una empresa regida por criterios de eficacia y eficiencia porque el estado es lento, ineficiente y corrupto, latiguillo que agitan como parte de una técnica de implantación de memoria colectiva. El estudiante es considerado como producto final y no como sujeto en formación. En los hechos, la realidad es muy otra ya que la alianza con el privado supone una intermediación que encarece los costos pues éste persigue objetivos de lucro, aunque pueda ahorrar en menores salarios o derechos para trabajadores del sector: docentes, técnicos, administrativos y auxiliares.
Por su parte, Torrendell es defensor del sistema más tradicional de privatización de la educación: los subsidios del estado a las escuelas privadas, principalmente a las iglesias y, en particular, a la iglesia católica de la que es activo militante como miembro del Consejo superior de la Universidad Católica. El estado argentino sostiene el 70% de la educación privada con fondos de sus presupuestos provinciales, que en algunas provincias como en Córdoba llega al 21,2%. Recientemente por indicación de Milei, se implementaron los “vouchers” o bonos directos a las familias que envíen a sus hijes a escuelas privadas, con hasta 75% de subsidio del estado y que tengan ingresos inferiores a 7 salarios mínimos (1.837.030$). El gobierno reforzó de este modo el sostén tradicional a la educación privada subsidiada, esta vez con fondos del presupuesto nacional. Estos resultaron de redireccionar la partida que otrora se destinaba al Fondo de Incentivo Docente y el Fondo compensador a las provincias que no llegaban a pagar el básico salarial estipulado por acuerdos federales.
Desde su asunción, Torrendell no ha hecho mucho en materia específica de educación, aparte de desmantelar programas existentes como la entrega de libros, el plan de Formación Docente, los equipos del canal Paka Paka y Canal Encuentro, entre otros actos de destrucción. El plan de Alfabetización, que le fuera presentado por una ong privada, y que tuvo su decreto en julio, es casi la única medida específica destinada a educación de su gestión. Se trata, en realidad, de una pátina hueca de acciones efectivas que distrae de su verdadera preocupación que está en otro lugar.
En diversas ocasiones, el secretario de educación ha señalado que la causa de la crisis de la educación en la Argentina está en las instituciones educativas, incluso haciendo la concesión de deslindar responsabilidad individual al o la docente. Ese es su punto de confluencia con Sturzenegger. El proyecto de ambos es cambiar de raíz la institución escolar estatal para pasar a ser un ámbito donde lo privado ingrese directamente a la escuela pública. Ha habido algunas señales en esa dirección en gobiernos anteriores como la contratación de consultoras privadas, agencias evaluadoras externas, capacitaciones a cargo de empresas y universidades privadas, uso de plataformas extranjeras para direccionar el aprendizaje en todos sus aspectos, tanto en la selección de contenidos como en el proceso mismo de enseñanza. Pero el modelo de APP pretende avances cualitativos. El objetivo es que la institución escolar funcione con gestión de tipo empresarial, más que con directores por concurso, con facultades de administrar al personal en calidad de recurso humano para producir un resultado, bastardeando el régimen laboral de los actuales estatutos docentes.
Desconocemos los pasos concretos que se estarían diseñando en este sentido. En algunos países se ensayan modelos como gerenciamientos de escuelas estatales por empresas privadas, con docentes contratados, por fuera de todo convenio laboral. Esta última modalidad ya existe en algunas provincias con los llamados programas a término donde la docencia está completamente precarizada, sin ningún tipo de estabilidad laboral por años.
El plus de este plan benéfico para los que pretenden lucrar con los fondos del estado es la posibilidad de controlar los contenidos de lo que se enseña de modo de disciplinar la escuela a la “Batalla cultural” que el gobierno de Milei anuncia cada vez que puede. Para este gobierno, “dictatorial latente”, la escuela debería servir a su lucha contra las ideas socialistas, de derechos humanos y de igualdad de género, imponiéndo a la fuerza si pudiera el modelo de derecha del capitalismo más salvaje que se conoce. Decimos “dictatorial latente” porque la resistencia de les trabajadores, de las mujeres y de los sectores populares de nuestro país no le ha permitido, a la fecha, avanzar en esa dirección.
Nos enfrentamos, por tanto, a la intención de generar las condiciones para una triple reforma: laboral, curricular e institucional. Apostemos a seguir organizando la resistencia, como hoy la marca la docencia de ATEN, para impedir su aprobación mediante la acción organizada a nivel nacional de la docencia con las familias y los estudiantes. Sigamos batallando por una escuela pública con presupuesto para una educación no dogmática, científica, con perspectiva de género, que cuide el ambiente para las generaciones presentes y futuras, al servicio de la lucha por una sociedad emancipada de toda forma de explotación y exclusión.
